Terms of Sale

These terms cover work from Cowboy Creations in Tolar, Hood County, Texas. A request on this site is an invitation to quote, not a contract, until I confirm a price in writing (email is writing) and you pay that price. They are written in plain language. They are not a substitute for a lawyer-reviewed contract if your job needs one.

Hours and how to reach me

You can send a request any day, any time. I’ll write you back when I’m at the bench. There is no walk-in storefront and no guaranteed same-day reply.

Quotes and payment

Numbers on the site are ballparks. The price that counts is the one I send you. Pay that amount on Venmo after I confirm. I do not take card numbers on this site. Texas sales tax is added when it applies; I will show it on the quote. I start the work after payment clears unless we agree otherwise in writing.

Pickup and mail

Pickup in Tolar is included when we set a time. Mail is extra. I will show you postage before you pay that part. Risk of loss on a mailed job passes when the carrier has the package, except that I stay responsible if I used the wrong address I copied from you incorrectly.

Your files and IP

If you send a file, photo, or sketch, you are telling me you have the right to have that thing made. You grant me a limited license to use those materials only to quote, model, print, and support that job. I do not claim your design. I may keep shop records of the job. I will not relist your file as my product.

If I model a replacement for you, that model is for your job. I may reuse general know-how. I will not sell your named, one-off design as a stock listing without asking you.

Not professional engineering

Unless a quote says otherwise in writing, this is custom fabrication and hobby-grade or replacement parts, not sealed professional engineering, not a load rating, and not a certified medical or safety device. If the part has to hold a person, a vehicle, or a regulated load, say so up front so I can decline or we can put the extra work in the quote.

Custom goods and defects

Made-to-order parts and name keychains are not returnable because you changed your mind, the color looks different on your screen, or the fit is wrong because the measurement or file you sent was wrong. If the print does not match what we agreed, or it failed in a way that is on my process, tell me within 14 days of pickup or delivery. I will reprint or refund that job at my choice. That is the exclusive remedy for a defective job, to the extent Texas law allows. Texas law on deceptive trade practices still applies to something I actually misrepresent.

Timing

Lead time is an estimate. It is not a guarantee unless the quote names a date and calls it a deadline. I will tell you if I am slammed.

Accounts

Customer accounts are invite-only. Keep your password to yourself. I may close an account that is being abused or used to probe the shop.

Limitation of liability

To the extent Texas law allows, my liability for a job is limited to the amount you paid me for that job. I am not liable for lost profits, downtime, or indirect damage. Some limits do not apply where the law does not let me disclaim them, including liability for my own fraud or gross negligence.

Governing law

Texas law governs these terms, without regard to conflict-of-law rules. Venue is the state courts in Hood County, Texas, unless the law requires otherwise.
